Privacy Policy

Introduction: This Privacy Statement explains how New Zealand Agri Brokers Limited (NZAB, we, us and our) collects, uses and shares personal information about you, and how you can access, correct or complain about that information. We collect and handle personal information in accordance with the Privacy Act 2020 (Privacy Act). For clients, further information about how we handle personal information is set out in our Standard Terms of Engagement.

Collection of personal information: We collect personal information about you and, in some cases, about people associated with you or your transaction. We collect personal information directly from you (for example, when you contact us, complete a form on our website, sign up to a newsletter, or engage our services), and indirectly from third parties (for example, from referees, other professional advisers, or publicly available sources).

Use of personal information: We use personal information to carry out your instructions, provide our services, communicate with you and, where you are a client, comply with and enforce our Standard Terms of Engagement. This may include client onboarding, mandate management, performance reporting, financial and business administration, and compliance with legal and regulatory obligations. We may also use personal information for internal analytics, trend analysis and improvement of our website and services and may create anonymised statistical data from that information for our own purposes.

What if you do not provide us with the information we ask for? If you do not provide us with the personal information we request, we may not be able to respond to your correspondence, process your application, provide the services or other engagement you have requested, or otherwise deal with any request or enquiry you have made. In some circumstances, failure to provide information when requested may be unlawful, or may result in other legal consequences. Where this is the case, we will explain the circumstances and the potential consequences to you at the time we collect the information.

We will only send you marketing communications where you have consented (for example, by subscribing to a newsletter or providing your email or mobile number for that purpose) and we will comply with the Unsolicited Electronic Messages Act 2007.
You may unsubscribe from marketing communications at any time by clicking the “Unsubscribe” link in each communication or by contacting our Privacy Officer at info@nzab.co.nz.

Who we share personal information with: We share personal information with third parties in the course of providing our services and running our business, including with:
(a) product providers, banks and non-bank lenders, financial product providers, investment companies, private equity funders and other funders, to whom we introduce or refer you or through whom the recommendations we make are implemented;
(b) our related companies and service providers who assist us in delivering our services; and
(c) any other third party where the sharing is authorised by you or required or permitted by law.
Some of our service providers may be located, or host their systems, in Australia, the Asia Pacific region, the United States or the European Union. Where we disclose personal information to a person or entity that is not physically present in New Zealand, is not ordinarily resident in New Zealand and (in the case of an entity) is not established under New Zealand law or managed or controlled from New Zealand, we will carry out due diligence to ensure that we have reasonable grounds to believe that the foreign person or entity meets at least one of the criteria in Information Privacy Principle 12 of the Privacy Act. Those criteria ensure that any disclosure of personal information outside New Zealand will be subject to privacy safeguards that are comparable to those under the Privacy Act. For the avoidance of doubt, where another person or entity (whether located within or outside New Zealand) holds or processes personal information on our behalf (for example, cloud storage or other IT service providers), the information is regarded as being held by us and does not constitute a disclosure of personal information.

Indirect collection: We may also collect personal information about individuals indirectly (that is, from a source other than the individual concerned), for example where financial or other information provided to us contains personal information about a client’s or counterparty’s directors, shareholders, beneficial owners, employees or contractors. Where we do so, we will take reasonable steps to notify the individual concerned of the matters specified in Information Privacy Principle 3A of the Privacy Act at the time of collection, or if that is not reasonably practicable, as soon as reasonably practicable after collection, unless an exception applies.

Cookies and other tracking methods: A cookie is a small amount of data that a website stores on your browser when you visit the site. When you return to the site, the browser may send that information back so the site can recognise you. Our website may use cookies for the following purposes:
(a) Functional cookies: necessary for the website to work properly.
(b) Analytical cookies: used to understand how visitors use the website and to improve its content and performance. We use Google Analytics for this purpose.
(c) Marketing cookies: used to make marketing communications more relevant to visitors.
You can manage or disable cookies through your browser settings. If you disable cookies, some parts of the website may not work properly.

Legal disclosures: We may share personal information where required or permitted by law, including in response to a court order or other legal process, or in connection with any legal claim or investigation.

Security: We take reasonable steps to protect personal information from loss, misuse and unauthorised access, modification or disclosure. Access to personal information is restricted to those staff and service providers who require it for the purposes described in this Privacy Statement.

Access, correction and complaints: You have the right under the Privacy Act to request access to, and correction of, any personal information NZAB holds about you. Requests should be made in writing to NZAB’s Privacy Officer at info@nzab.co.nz with the words “ATT: THE PRIVACY OFFICER” in the subject line. NZAB will review requests as soon as reasonably practicable to comply with its legal obligations (with a response deadline of 20 working days). If you are not satisfied with NZAB’s response to a privacy concern, you may make a complaint to NZAB using the same contact details, and NZAB will respond as quickly as possible (with a target response of 20 working days). If your concern remains unresolved, you may make a complaint to the Office of the Privacy Commissioner (privacy.org.nz).

Changes to this Privacy Statement: We review this Privacy Statement regularly and may update it from time to time. Any updated version will be posted on this page and will be effective when posted. If we make significant changes, we will take reasonable steps to bring those changes to you including (where practicable) by email to individuals for whom we hold contact details, and by a prominent notice on our website.
